Brazil Potash Corp. has secured a series of favourable appeal court decisions that block federal prosecutors and indigenous groups from referring legal challenges to Brazil's superior courts, keeping the environmental licenses for its flagship Autazes Project fully in force.

The Vice-President of the Federal Regional Court of the 1st Region ruled that special and extraordinary appeals filed by the Federal Public Prosecutor's Office, the Mura Indigenous Leadership Organization of Careiro da Várzea, and the Lago do Soares Indigenous Community failed to meet the necessary procedural requirements for review by the Superior Court of Justice and the Federal Supreme Court.

Consequently, prior rulings issued by the court's 6th Panel remain active. Those baseline decisions recognize the formal regularity of the consultation process conducted with the Mura Indigenous people, validate the licensing authority exercised by the Amazonas Environmental Protection Institute, and confirm the continued legal force of the environmental permits issued for the development. While opposing parties retain the option to pursue interlocutory appeals against the inadmissibility determinations, the court’s action preserves the operational validity of the permits as the developer advances its schedule.

Brazil Potash is developing the Autazes Project in Amazonas State as its primary potash fertilizer asset. The company awarded Front-End Engineering Design contracts for surface infrastructure, mine shafts, and underground development across the Autazes Project.

The developer is utilizing the legal clarity provided by the appellate rulings to advance toward full construction of its Autazes Project following recent court rulings confirming the validity of its environmental licenses and the Mura consultation process, while continuing active dialogue regarding construction debt financing with Development Finance Institutions and Export Credit Agencies.
