Brazil Potash Corp. has protected its construction and development timeline at the Autazes Potash Project after Brazil’s Supreme Federal Court rejected a legal petition seeking to halt permits and site activities.

The ruling by the nation's highest court leaves in place favorable decisions previously issued by the Federal Court of Appeals. The challenge, filed by the Federal Public Defender's Office, attempted to suspend provisional relief supporting the asset. Justice Edson Fachin rejected the petition in full, determining that the applicant failed to demonstrate serious harm to public order or the economy and that such proceedings cannot replace the appropriate appellate process.

With the petition dismissed, the Autazes Project’s licensing status and ongoing development work remain fully active and unaffected. A court-supervised consultation process involving the Mura people previously yielded over 90% support for the development.

The latest Supreme Court decision builds on a series of favorable legal outcomes for the company. Brazil Potash previously secured rulings from the Federal Regional Court of the 1st Region confirming the validity of the environmental licenses and the formal regularity of the Mura consultation process for the project.

The legal defense coincides with recent fiscal developments aimed at lowering upfront capital requirements for the construction phase. The Brazilian Senate passed the Profert legislation, which establishes tax incentives that could provide potential relief of up to approximately US$190 million against the Autazes project’s US$2.5 billion initial capital expenditure budget. That potential relief combines with previously established incentives from the Superintendence of the Manaus Free Trade Zone to reduce the upfront capital needed before construction begins.

The Profert fertilizer legislation currently awaits signature into law by President Luiz Inácio Lula da Silva in the coming weeks.
